Agreement to Terms

By downloading, installing, or using any mobile application developed by MIFASUSE YAZILIM ANONIM SIRKETI ("we," "our," or "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use our applications.

Scope of This Agreement

This Terms of Use applies to all mobile applications developed and published by Mifasuse under the Mifasuse brand.

License Grant

Mifasuse grants you a limited, non-exclusive, non-transferable, revocable license to use our applications for personal, non-commercial purposes, subject to these Terms.

Account and Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities under your account
  • You must provide accurate and complete information
  • You must be at least 13 years old to use our applications

Acceptable Use

You agree NOT to:

  • Use the application for any illegal purpose
  • Attempt to reverse engineer, decompile, or hack the application
  • Share your account credentials with others
  • Use the application to harm, harass, or threaten others
  • Collect or harvest data from other users
  • Interfere with the application's operation or security
  • Upload malicious code, viruses, or harmful content

User Content

  • You retain ownership of any content you create within our applications
  • You grant us a license to use your content to provide application features (e.g., AI analysis)
  • You are responsible for the content you create
  • We may remove content that violates these Terms or applicable laws

Subscriptions and Payments

Auto-Renewable Subscriptions

Some of our applications offer premium features through auto-renewable subscriptions.

Subscription Options:

  • Weekly Subscription: Billed weekly, provides access to premium features for one week
  • Monthly Subscription: Billed monthly, provides access to premium features for one month
  • Yearly Subscription: Billed annually, provides access to premium features for one year

Premium Features May Include:

  • AI-powered analysis and insights
  • Advanced statistics and reporting
  • Ad-free experience
  • Enhanced security features (PIN protection)
  • Exclusive themes and customization options
  • Personalized recommendations

Pricing and Payment:

  • Subscription prices are displayed in the application before purchase
  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
  • Prices may vary by region and are subject to change with notice
  • All payments are processed securely through Apple App Store or Google Play Store

Automatic Renewal:

  • Your subscription will automatically renew at the end of each billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • The renewal charge will be the same as the initial subscription price unless you are notified otherwise
  • To avoid being charged, you must turn off auto-renewal at least 24 hours before your subscription ends

Managing Subscriptions:

For iOS (iPhone/iPad):

  • Go to Settings → [Your Name] → Subscriptions
  • Select the subscription you want to manage
  • Cancellation takes effect at the end of the current billing period

For Android:

  • Open Google Play Store app
  • Tap Menu → Subscriptions
  • Select the subscription you want to manage

Free Trials (if offered):

  • Free trial periods, if offered, allow you to try premium features at no cost
  • You may cancel anytime during the free trial without being charged
  • If you don't cancel before the trial ends, you will be automatically charged for the subscription
  • Any unused portion of a free trial will be forfeited upon purchasing a subscription

Refunds:

  • All purchases are final and non-refundable except as required by law
  • Refund requests must be made through Apple App Store or Google Play Store, not through Mifasuse
  • We do not have the ability to issue refunds for purchases made through app stores

Intellectual Property

  • Our applications and their content are owned by Mifasuse and protected by copyright, trademark, and other intellectual property laws
  • You may not copy, modify, distribute, sell, or create derivative works
  • "Mifasuse" name and logo are our registered trademarks
  • Application names and logos are our trademarks

AI-Powered Features

  • Some premium features may use artificial intelligence for analysis and recommendations
  • AI-generated content is provided "as is" and should not be considered professional advice
  • We cannot guarantee the accuracy or completeness of AI-generated insights
  • AI analysis may be processed by third-party services (e.g., OpenAI) in accordance with their privacy policies

Not Professional Advice

Our applications are wellness and productivity tools, NOT substitutes for professional medical, mental health, legal, or financial advice. If you are experiencing a health crisis, please contact a qualified healthcare professional or emergency services immediately.

Application Availability

  • We strive for reliable service but cannot guarantee uninterrupted availability
  • Applications may be unavailable due to maintenance, updates, or technical issues
  • Features may be added, modified, or removed at our discretion
  • We may discontinue applications with reasonable notice

"As Is" Basis

  • Applications are provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not warrant that applications will be error-free, secure, or uninterrupted
  • Your use of applications is at your own risk

Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for subscriptions in the past 12 months
  • We are not responsible for data loss, device damage, or other technical issues
  • Some jurisdictions do not allow these limitations, so they may not apply to you

Indemnification

You agree to indemnify and hold harmless Mifasuse, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our applications or violation of these Terms.

Privacy

Your use of our applications is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by:

  • Posting a notice in the application
  • Updating the "Last Updated" date
  • Sending a push notification (if enabled)

Continued use of applications after changes constitutes acceptance of the new Terms.

Termination

  • You may terminate your account at any time by deleting the application
  • We may terminate or suspend your access if you violate these Terms
  • Upon termination, you lose access to your account and data
  • Paid subscriptions are non-refundable upon termination
  • Certain provisions (Intellectual Property, Limitation of Liability) survive termination

Data Deletion

You may request deletion of your account and data through application settings or by contacting us. Upon deletion:

  • Your account will be permanently deleted
  • All user-generated content will be erased
  • Your subscription will be cancelled (no refund for remaining period)
  • This action cannot be undone

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.

Dispute Resolution

For any disputes, we encourage you to contact us first to seek an informal resolution. If informal resolution fails, disputes will be resolved through binding arbitration in accordance with Turkish law.

App Store Compliance

Your use of our applications is also subject to:

  • Apple's App Store Terms of Service (for iOS apps)
  • Apple's Licensed Application End User License Agreement (EULA)
  • Google Play Terms of Service (for Android apps)

In case of conflict between these Terms and app store terms, the app store terms shall prevail.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mifasuse regarding our applications.

By using any Mifasuse mobile application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
